Food Truck Permit
RULES AND REGULATIONS (In Part):
This list is not intended to supersede the Land Development Ordinance (LDO). For a full list of Food Truck regulations, refer to Article F Use Regulations, Section 9-1255, j. (2) Food Trucks.
• Food trucks must comply with all local, county, state and federal laws.
• A maximum of three (3) food trucks are permitted per individual lot unless part of a permitted special event.
• Food trucks shall only be located on developed property that is occupied by a principal nonresidential use currently in operation, except as provided in the LDO.
• Food trucks may operate only while the host business is open and shall not be stored or parked overnight.
• Food trucks may operate between 7 am and 11 pm.
• Food Trucks are NOT permitted along:
o NC 42 Hwy
o NC 55 Hwy
o US Hwy 401
• One (1) sandwich board sign is permitted.
• Amplified sound is not permitted.
SUBMITTAL CHECKLIST:
• One (1) completed Application for Food Truck Permit.
• Copy of most recent Department of Health or Agriculture permit, inspection report, or proof of exemption.
• $75 permit fee (this fee is to be collected prior to issuing the permit).
THE PROCESS:
1. The applicant must complete the Application for Food Truck Permit. Incomplete applications or inaccurate information will prevent or delay
processing and review.
2. Planning Department staff will complete review of the application. Application review is performed within seven (7) business days.
3. If the application is complete and in compliance with the Land Development Ordinance, staff will contact the applicant with payment instructions. The Food Truck Permit will be issued after the
$75 permit fee is paid. Permits are valid for one (1) year from the date of issuance.
