For Athlete & Parent : MSST Release Agreement*

I, in consideration of being allowed by Great Eastern Resort Management to participate and be a member of the Massanutten Ski/Snowboard Team do hereby release and agree to hold harmless and indemnify the Massanutten Resort Ski Area and Snow Sports staff from any and all claims, actions, or damages without any limitation whatsoever, whether consisting of personal injury, property damage or death, that does or may result in any way from my participation in this program.

I further realize that skiing/snowboarding and particularly racing and freestyle competitions have categories of inherent risks that skiers/snowboarders MUST ASSUME if they participate in the sport. They include but are not limited to variations in snow and terrain, ice, rocks and forest growth (above or below surface), bare spots, towers, utility lines and their components, well-marked or plainly visible snowmaking and snow grooming equipment, and collisions. Read and heed all posted signs. If you cannot accept the inherent risks of the sport, please do not purchase a pass at this area.

I agree that the state and federal courts located in Rockingham County, Virginia shall be the sole venue for any legal dispute arising from this agreement or from my participation in the event, even though some other jurisdiction or venue may be permissible or more convenient. In the event any section of this release is found to be unenforceable, the remaining shall be fully enforceable.

I acknowledge my understanding of the above and waiver of rights that I would otherwise have had, had this agreement not been executed.

WARNING: Under Virginia law, a ski area operator or other winter sports area operator is not liable for an injury to or death of a winter sports participant in a winter sport conducted at this location, or for damage to property, if such injury, death, or damage results from the inherent risks of the winter sport or from the participant’s own negligence. The inherent risks of a winter sport include, among others, risks associated with the land, equipment, other participants, and animals, as well as the potential for you or another participant to act in a negligent manner that may contribute to the injury, death, or damage. You are assuming the inherent risks of participating in a winter sport at this location. Complete copies of the applicable Virginia law and the participant responsibility code published by the National Ski Areas Association are available for review at each ticket sales office of this winter sports area and online at www.massresort.com/wintersportssafetyact

I am subject to the following:

I MUST BE ON TIME, BOOTED, AND ON THE SNOW READY TO GO AT 5:25PM FOR NIGHT PRACTICES AND 8:55AM FOR MORNING PRACTICES.

1. Obey all rules and regulations of the Ski Area, especially “THE RESPONSIBILITY CODE”.

4. Attend (as a minimum) an average of one practice session per week. If unable to attend, I will provide an explanation and communicate this by email to the Team Supervisor.

5. I will NOT enter the Instructors’ Room, Ski Area Office, Rental/Repair Shop, or Mountain Cruisers Room unless accompanied by a team coach and on official business.

6. Be independently lift capable. I can raise/lower the bar by myself. I will wear a helmet AND appropriate MSST TEAMwear at all practices and competitions.

I realize that failure to comply with these requirements can result in a temporary or permanent loss of team membership or skiing/snowboarding privileges. I hereby understand and agree to the Massanutten ski & Snowboard Team Member's Pledge.

For Parent: MSST Parent's Pledge: Code of Conduct Contract*

The goal of MSST is to make skiing and snowboarding fun for athletes of all ages while training and competing in a safe appropriate environment. It is imperative that athletes, coaches, parents, families, spectators and race officials conduct themselves with the highest degree of sportsmanship.

To facilitate this objective, MSST, SARA, US SKI & SNOWBOARD, USASA, have a Code of Conduct for the athletes; MSST has also extended these expectations to include the following MSST Parent’s Pledge:

MSST parents strive to provide positive support and encouragement for their athlete(s) participating with MSST by following this Parents’ Code of Conduct:

•   I will inform the coach and the appropriate snow sports administrator of any physical, mental or emotional disability or ailment that may affect the safety of my child or others.

•    I will learn the rules of the sport and abide by the policies of MSST, SARA, US Ski & Snowboard, USASA, FIS and any other snow-sport governing association.

•    My guests and I will be positive role models for my child and encourage sportsmanship, respect and courtesy, and adhere to core values of respect, integrity, teamwork, learning and excellence.

•    I will place the emotional and physical well-being of my child ahead of a personal desire for them to perform well.

•    I will not encourage or engage in any behaviors or practices that would endanger the health or well-being of the athletes

•    I will teach my child to train and compete by the rules and to resolve conflicts respectfully, peacefully and diplomatically.

•    I will demand that my child treat other competitors, coaches, officials and spectators with respect, regardless of race, color, creed, sex or ability.

•    I will never ridicule, humiliate or yell at my child or other participants for making a mistake or losing a competition. •    I will do my very best to make training and competing fun for my child.

•    I will help my child enjoy the MSST experience by doing whatever I can, such as volunteering, being a respectful fan or assisting with club duties.

•    I will respect the officials and their authority during events and support coaches working with my child in order to encourage a positive and enjoyable experience for all.

•    I will demand a sports environment for my child that is free from vulgar language, drugs and alcohol. My guests and I will use alcohol responsibly.

•    I recognize that the relationship between an athlete and a coach can be altered dramatically by the presence of a parent. Therefore, during training and competition sessions, I will do my best to “observe from afar”.

•    I will refrain from coaching my child or other athletes during training and/or competitions, unless I am asked to assist by a coach.

•    I understand that I am only allowed on the training and event venue if I am a gatekeeper or official or I am performing course maintenance.

•    Parent, athlete and coach communication is very important! If an issue arises I will respectfully approach, in this order: my child’s coach then the head coach for communication and resolution. If additional resolution is needed a parent advisory panel will be engaged.

•    I understand that my failure to follow the Parents' Code of Conduct can result in suspension or removal from MSST without refund.

I agree and understand the MSST Parent's Pledge: Code of Conduct Contract.
