TERMS AND CONDITIONS

Customer Agreement

The Customer and Appalachian Power Company agree the Customer has chosen to receive service under the provisions of the Company’s Tariff RS-PEV. The Customer agrees to pay the Company monthly for electric energy delivered hereunder at the rates and under the provisions of the Company's Tariff RS-PEV, as regularly filed with the West Virginia Public Service Commission, as long as that schedule is in effect. The residential PEV tariff is available for Appalachian Power’s West Virginia residential customers served by an existing residential billing tariff who use charging stations for Plug-In Electric Vehicles (PEV) programmed to consume electrical energy primarily during off-peak hours specified by the Company, who take Standard Service from the Company and currently have an Automated Meter Infrastructure (AMI) meter. The PEV must be a licensed electric motor vehicle which is subject to state inspection, and which is either owned or leased by the Customer. The Customer agrees to take electrical service under the above tariff as electrical energy supply for the charging of a registered Plug-in Electric Vehicle in the State of West Virginia. The Customer assumes the full obligation to comply with all codes and standards applicable to the installation of such equipment. The Company reserves the right to require a separate meter at the customer’s premise for the EV charger installation, and reserves the right to install the equipment necessary to allow the Company to remotely communicate with the Electric Vehicle Supply Equipment (EVSE). PEV’s eligible to be served under this tariff will be metered through one single-phase, multi-register AMI meter capable of measuring electrical energy consumption during on-peak and off-peak billing periods. Metering that is capable of separately identifying PEV usage shall be installed at the Company’s discretion. All installations must conform to Company specifications. Customers choosing service under the RS-PEV tariff are required to enter into a written service agreement including proof of purchase of a qualifying PEV. Should the Customer discontinue operating the qualifying PEV, the Customer will notify the Company so arrangements can be made to remove the PEV metering & terminate service under this schedule.

Verification

All equipment installations are subject to verification by the Company to ensure the equipment is properly installed and operating, and an inspection may be conducted. The Company reserves the right to inspect at all reasonable times the devices, which qualify the residence for service and the Residential PEV tariff. If the Company finds that in its sole judgement the conditions of this tariff are being violated, it may discontinue billing the customer under this tariff and commence billing under the appropriate Residential Service Tariff.

Indemnification

Signatory(ies) and applicant(s) shall hold harmless and indemnify Appalachian Power, the Program Coordinators, and their respective affiliate subsidiaries, parent companies, officers, directors, agents and employees against any and all losses, damages, expense, fees, costs and liability arising from any design, consulting, product, system, equipment or appliance or any one claim, in connection with the Program.

Application Review Process

Appalachian Power will review final applications for eligibility and completeness. Completed applications will be reviewed in the order received. Applicants who submit incomplete applications will be notified of deficiencies upon review of the application. There are no unwritten understandings or agreements relating to the service herein above provided. This Contract shall be in full force and effect when signed by the authorized representatives of the parties hereto. Customer represents he/she/they is/are authorized to sign this agreement and to install the Electrical Vehicle Supply Equipment including submeter. No site work should be conducted until eligibility is confirmed.
