We may collect certain categories of personal information from or about you when you apply to become a Community Stylist or participate in the Program. These categories may include biographical information (i.e., name, social security number (for tax purposes), mailing and shipping address), contact information (i.e., email address, phone number), unique personal identifiers (i.e., social media handles), commercial information (i.e., sales history), payment card information, visual information (i.e., videos or photos that you upload), information about your interests and preferences, and inferences drawn from the above categories of personal information. If you refuse to provide requested information (whether or not required), you may not be able to take full advantage of offers related to the Program.

Additionally, when you use any Kendra Scott websites or interact with our emails or online advertisements, including in relation to the Program, we or our third-party business partners (“Preferred Providers”) may use cookies, pixel tags, or similar technologies to automatically or passively collect certain information for online and offline marketing purposes and for analytics. Our consumer privacy policy provides additional information about these tracking technologies, the types of information that we may automatically collect, and choices that may be available to manage your preferences. We do not respond to Do Not Track requests.

When we operate or market the Program, we may combine the information we receive from and about you, including information you provide to us as part of the Program, information we collect from you as a consumer or visitor of our online store or retail locations, and information we automatically or passively collect about you using cookies or similar technologies.

INFORMATION USE

We may use the information we collect from and about you for various business purposes, such as to run the Program, maintain contact with Community Stylists, process Community Stylist orders, prevent and detect fraud and abuse, for billing purposes, and/or as described to you at the point of collection. We may also use information we collect from and about you for commercial purposes, such as to analyze or improve the Program and our websites, and/or for direct marketing, advertising, or promotional purposes. We may store this information for as long as is reasonably necessary to accomplish these tasks, unless the law permits or requires a longer period.

INFORMATION DISCLOSURE

We may disclose the information we collect from and about you, including your personal information, (1) to our Preferred Providers, if the disclosure will enable them to perform a business, commercial, professional and/or technical support function for us; (2) to tax authorities where reporting is required by law; (3) if and when applicable, to other Community Stylists to manage their downline businesses and assign leads (limited to your name, contact information, purchase information (where applicable), and the sales volume associated with the purchase (where applicable)); (4) as necessary if we believe that there has been a violation of our rights or the rights of any third party; (5) to respond to judicial process or provide information to law enforcement or regulatory agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law; and (6) as described to you at the point of collection.

Kendra Scott may sell or purchase assets during the normal course of our business. If another entity acquires us or any of our assets, information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, such information may be considered an asset of ours and may be sold or transferred to third parties. Should such a sale or transfer occur, we will use reasonable efforts to try to require that the transferee use the information provided as part of the Program in a manner that is consistent with this Privacy Policy.

•    Preferred Providers: We may contract with Preferred Providers to perform functions that support the Program. Such Preferred Providers will have access to the information collected as necessary to perform their business, commercial, professional and/or technical functions for Kendra Scott.

•    Community Stylist Locator: If and when applicable, you may opt to be included in our Community Stylist Locator feature on the Kendra Scott website. When you do so, your name and contact information may be featured within the locator, and you may be contacted as a result. You may remove your contact information from the Community Stylist Locator at any time by contacting directretail@kendrascott.com.
