Lead Service Line Replacement Plan (LSLRP) Summary    


BACKGROUND & INSTRUCTIONS


MassDEP will use the information in this LSLRP Summary to provide technical assistance to your system and assist your system to identify resources to further develop and implement your plan and replace all lead service lines. This information is not intended for enforcement purposes.


All public water systems (PWS) with one or more lead, galvanized requiring replacement (GRR), or lead status unknown service lines in their distribution system must complete and submit a lead service line replacement plan to the Department by October 16, 2024. According to the US Centers for Disease Control (CDC) "Because no safe blood level has been identified for young children, all sources of lead exposure for children should be controlled or eliminated". See https://www.cdc.gov/nceh/lead/prevention/sources/water.htm. As such, MassDEP is encouraging PWS to plan to expeditiously remove all lead service lines.


PWSs seeking Drinking Water State Revolving Funds (DWSRF) to address lead service lines are expected to complete the MassDEP Lead Service Line Inventory Workbook and this Lead Service Line Replacement Plan Summary Form or provide comparable electronic data that is acceptable to the Department.

*MassDEP encourages prioritization consideration for sensitive populations and previously known lead concentrations.

 
 

 

Example: The prioritization of the replacements is focused on identifying areas with sensitive populations such as nursing homes and nursery schools. Past sampling events have shown that these areas also have high lead results. By focusing replacement on these areas first, we are addressing the areas where lead contamination has the most adverse impacts on the health of those who drink the water.

Example: prior to replacing the property-owner portion of a lead service line, a contract between the water system, contractor, and property-owner must be signed and executed through the following process.

 
 

 

RECOMMENDED REPLACEMENT GOAL RATE    


Under the LCR, systems that exceeded the lead action level of 15 ug/L based on their 90th percentile sample result after installing corrosion control and/or source water treatment (whichever sampling occurred later) are required to replace 7% of their LSLs annually until they no longer exceeded the lead action level for two consecutive monitoring periods (40 CFR 141.84(a)). The replacement rate must be applied to all known lead and galvanized requiring replacement service lines when the system first exceeds the trigger level plus the number of lead status unknown service lines in the beginning of each year of a system's goal-based lead service line replacement program. To protect public health, MassDEP encourages all other systems with LSL, including those systems serving less than 10,000 in population to establish a planned replacement rate.

4. COMMUNICATION

 

COMMUNICATION, LEAD EDUCATION, TRANSPARENCY STRATEGY, AND PLAN

 

According to EPA, general lead education, a transparency strategy, and a plan are needed to inform consumers about why it is necessary to remove lead plumbing and lead service lines and how they can help themselves to get the lead out. PWSs should include information on where consumers can find information on their service lines, how to find lead free plumbing devices, what tools the public water system will use to engage the consumers including, e.g., social media, local advocacy groups in person outreach, involvement with local health boards, etc. If your system serves communities of non-English speaking consumers, should have plans for outreach in non-English languages*. If applicable, refer to your system’s Lead and Copper Sampling Plan for additional public education and notification requirements under an ALE. For an ALE, the information will need to include what your water system is doing regarding your LSLR program. PWSs will be expected to “provide notification to persons served by the water system at the service connection with an LSL, galvanized requiring replacement (GRR), or lead status unknown service line. Materials must be in appropriate languages if the water system serves communities with a large proportion of non-English speaking consumers, as determined by the state, see https://www.mass.gov/info-details/requirements-for-language-translations (copy/paste the link into a new browser tab). Notification within 30 days after completing of initial inventory and repeated annually until only non-lead remains. For new customers, water systems must also provide this notice at the time of service initiation,” per EPA.

 
 

*All notification letters must also include a written notification in any language in which greater than 10% of the population served by the water system speaks less than very well. Example: Our system will use monthly bill stuffers, monthly social media messaging, maintain web information and partner with the local Board of Health to include lead plumbing questions on all health-related forms. We will also partner with a local advocacy group of local high school to develop and provide information to each household. We will evaluate the success of the program on a quarterly basis, tracking the number of lead service line removed and will make adjustments, as needed.
