Law Enforcement Facility Classification Survey

The Governor’s Crime Commission (GCC) of the NC Department of Public Safety serves as the chief advisory body to the Governor and to the Secretary of Public Safety on crime and justice issues. The GCC is the Designated State Agency (DSA), as required by 34 U.S.C. § 11133(a)(1) and (2), responsible for administering the Title II Formula Grant Program. As a condition of administering this funding, the GCC is responsible for monitoring law enforcement facilities across the state for complinace with all applicable requirements of the Juvenile Justice and Delinquency Prevention Act (JJDP Act).

Please note that the federal definitions, for purposes of compliance monitoring, are only those provided in the JJDP Act at 34 U.S.C. § 11103 the Formula Grants Program Regulation at 28 C.F.R. § 31.304.

Pursuant to 34 U.S.C. § 11133(a)(14), states must provide for an effective system of monitoring jails, lockups, detention facilities, correctional facilities, and other secure facilities to ensure compliance with the core requirements of the JJDP Act .

Facility Information

States are required under 28 C.F.R. § 31.303(f)(1)(i)(B) to classify each facility in the monitoring universe to specify whether it is a (1) a jail or lockup for adults; (2) secure detention facility; or (3) secure correctional facility.


If your facility is determined to be a secure facility, you are subject to monitoring for compliance with provisions of the JJDP Act.

Pursuant to 28 C.F.R. § 31.303(f)(1)(i)(D) and (5), the state must collect and verify data from all secure facilities for the 12-month federal fiscal year reporting period, to determine whether the facilities are in compliance with the applicable requirements of the JJDP Act.

Inspection of facilities is required in order to confirm the proper classification of facilities, assess whether a facility’s record keeping system is adequate to determine if violations have occurred, and assess sight- and sound- separation at all points in the facility.

Annual Facility Classification Survey

The classification of jails and lock ups is confirmed on site as part of the inspection process. In addition to collecting data during site visits, the GCC collects and verifies juvenile admissions data ("juvenile holding log") from secure facilities in the state.


Data collection occurs at the end of each quarter of the Federal fiscal year (October 1 - September 30).
