Volunteer Service Agreement

Iowa State University is pleased that _(volunteer named above)___ (“Volunteer”) has decided to participate in an Iowa State University (“ISU” or “University”) and the FIRST LEGO League of Iowa in agreement with the Office of Engineering Outreach and Talent Development (“the Department”) volunteer service opportunity. ISU welcomes you as an authorized volunteer. In consideration for participating in the volunteer service opportunity, Volunteer accepts the following terms and conditions:

I. Volunteer Service Arrangements:

A. Volunteer Services.

Volunteer understands that they have been authorized to conduct the volunteer service defined and described below. Any modifications to scope of service must be done in writing and approved by the Volunteer Supervisor and the Department Chair or Unit Director.

c. College of Engineering, Engineering Outreach and Talent Development

d. Qualifiers, Expos, and State Championships in Iowa including Webster City, Cedar Falls, Dubuque, West Des Moines, Waterloo, Davenport, Marshalltown, Cedar Rapids, DeWitt, Gilbert, Kingsley, Ames, and Coralville.

e. November 18, 2024 – May 15, 2025

f. Program description: Youth STEM development program.

g. General description of tasks Volunteer is expected to observe and/or perform: Helping to host and/or staff a FIRST LEGO League event.


B. Designation as Volunteer.

Volunteer understands and acknowledges the Volunteer Services are not being provided in exchange for any compensation (e.g., no pay, benefits, or the promise of future employment). Further, Volunteer shall not hold themselves out as an employee of ISU or the Department. Volunteer also has no authority to enter into contracts or make financial commitments on behalf of any ISU division, department, or organization.


C. Background Check Requirement.

A background check may be required for proposed volunteers with responsibilities including but not limited to minors or vulnerable populations, access to keys to university facilities, or access to financial or confidential matters. This may include a National Sex Offender Registry or a Criminal record check before Volunteer service begins. Volunteers will also have a motor vehicle record (MVR) check if driving on University business.


D. Termination.

The Parties have the right to terminate this Agreement at any time and for any lawful reason.


E. Automatic Termination.

An individual may not serve as an ISU volunteer if they have been or become convicted of sexual abuse or any other criminal offense for which an individual must register under Iowa Code Chapter 692A. These types of criminal offenses disqualify an individual from serving as an ISU Volunteer. If Volunteer is convicted of such a crime during the Term of this Agreement, Volunteer must promptly report the conviction to the Volunteer Supervisor and the Agreement will automatically terminate.


F. Transportation.

Volunteer hereby acknowledges that they are responsible for transportation to and from Volunteer Services.


G. Return of ISU Property.

Upon termination or expiration, of this Agreement, Volunteer shall promptly return any and all ISU or Department property.


H. Volunteer Performance Expectations.

Volunteer must have the requisite skills and ability to effectively communicate and engage in the activities outlined in Attachment 1 and agrees to provide documentation upon request.


I. Behavior Expectations.

Throughout the Term of this Agreement, Volunteer is expected and required to follow the directions and guidance of the Volunteer Supervisor. Volunteer also agrees to follow any schedule established in connection with the Volunteer Services. Further, Volunteer is expected and required to comply with all applicable:

  1. Federal, State, and Local laws;
  2. 2.ISU policies, rules, and regulations; and
  3. 3.Policies and standards of College of Engineering, Outreach and Talent Development, together with all related training in general and specifically applicable to the volunteer service.


II. General Conditions.

A. Health Insurance Requirements; No Workers’ Compensation Coverage.

As a volunteer you are not an employee or contractor of ISU, the Department or the State of Iowa, and you will not be compensated monetarily for your volunteerism. Volunteer is not entitled to any employee benefits. The University will not provide Volunteer with accident or medical insurance, and is therefore not responsible for any accident or medical expenses that Volunteer may incur in the course of volunteering. Volunteer is not covered by workers compensation laws in connection with the Volunteer Services being provided hereunder. Throughout the Term of this Agreement, Volunteer must carry their own health insurance that will cover any personal injury that Volunteer could sustain while providing Volunteer Services and/or using University facilities and equipment. Upon request, Volunteer agrees to provide proof of such health insurance.


B.Iowa Tort Claims Act.

Subject to the determination of the Iowa Attorney General in each particular case, Chapter 669 of the Code of Iowa provides for defense and indemnification of Iowa State University volunteers while they are acting within the scope of their authorized volunteer duties, and while under the direction and supervision of the University.


C. Intellectual Property.

Volunteer agrees that any intellectual property created as part of these Volunteer Services shall be owned by ISU, unless a separate written agreement exists. Volunteer may be granted access to the research of ISU faculty and students. Volunteer agrees to protect and maintain the confidentiality of the research products of such faculty and students. Volunteer will not use data or research of ISU employees and students without permission and appropriate attribution of credit.


D. Confidentiality.

In the course of the volunteer experience, Volunteer may have access to certain data and information that is considered confidential, including, but not limited to, information about the Department and University activities, employees, students, and financial or business practices. Volunteer agrees that any and all data and information that they may receive or otherwise discover while volunteering is considered confidential information. Volunteer agrees not to disclose or discuss any confidential information with any third parties while volunteering or at any time after volunteering. Volunteer agrees to keep such data and information confidential and comply with all laws and regulations concerning the confidentiality of such records and information.


E. Driving Privileges.

Requests to drive an ISU vehicle, golf cart, or ATV must be approved by the Office of Risk Management. The Office of Risk Management will complete a motor vehicle record check every twelve (12) months. Volunteer must read, understand and comply with the rules and requirements of the ISU Fleet Safety and Volunteer Policy, both available in ISU’s Policy Library, accessible at: http://www.policy.iastate.edu/. Volunteers are not allowed to have one-on-one interaction when transporting youth for a youth program.


  1. Notice of Motor Vehicle Conviction or Charges. Volunteer agrees to promptly notify their Volunteer Supervisor and the Office of Risk Management of any motor vehicle conviction or charges pending (other than parking violations) including but not limited to notice of violation of statutes that affects a driver’s license, or notice that driving privileges are suspended, revoked, or barred for violating such statutes, such as Operating While Intoxicated, vehicular homicide or habitual violations, or any driving offense punishable as a felony.
  2. Personally Owned Vehicles; Motor Vehicle Insurance. Traveling in a personally owned automobile in conjunction with the Volunteer Services is not covered by ISU for property damage, liability or other insurance purposes. The vehicle owner is required to carry motor vehicle liability insurance as required by the State of Iowa or as required by the state in which the vehicle is registered. If Volunteer drives a vehicle that is not registered in Volunteer’s name, Volunteer must have the vehicle owner’s permission to drive and must inform the owner that Volunteer is responsible for property damage and liability. Drivers must have a valid U.S. driver’s license. Upon request, Volunteer must provide proof of auto liability insurance. Personal vehicles must not be used to transport participants of Sponsored or Endorsed youth programs.


F. ISU Volunteer Policy.

Volunteer hereby acknowledges that they have read, understands, and agrees to abide by ISU’s ‘Volunteer’ policy, accessible at: http://www.policy.iastate.edu/policy/volunteers.


G. University Non-discrimination Statement.

Volunteer hereby acknowledges that they agree to not discriminate on the basis of race, color, age, ethnicity, religion, national origin, pregnancy, sexual orientation, gender identity, genetic information, sex, marital status, disability, or status as a U.S. Veteran while they are acting within the scope of their authorized volunteer duties, and while under the direction and supervision of the University.


H. Photo and Media Release.

Volunteer hereby grants the University unrestricted permission to use and re-use photographic portraits, editorials, video, digital or film images, or any pictures taken of myself individually or in conjunction with other photographs during the volunteer experience, in any printed or video-graphic matter, in any and all media, and for any purpose allowed by law. Volunteer hereby waives any right to compensation for such use and any right to inspect or approve the finished products that may be used in connection with the above mentioned images. In addition, during virtual programs or opportunities, Volunteer acknowledges and accepts that their location, setting, or other personal information may be electronically captured or displayed.


I. Assumption of Risk, Release of Liability, and Hold Harmless Agreement.

Volunteer (and parent/guardian if applicable) hereby acknowledges and accepts that the volunteer activity that the Volunteer is participating in has inherent risks that may result in personal injury or loss, property damage, and/or bodily injury (including death). Volunteer (and parent/guardian if applicable) hereby agrees to assume all risk of personal injury or loss, property damage, and bodily injury (including death), resulting from or arising out of participation in the designated volunteer activity. In addition, Volunteer (and parent/guardian if applicable), on behalf of themselves, their heirs and their representatives, hereby releases, waives, and agrees to hold harmless ISU, the State of Iowa, the Board of Regents of the State of Iowa, its affiliates and their respective successors, assigns, officers, directors, employees and agents from any and all liability, damage or claim arising out of or relating to Volunteer’s Volunteer Services.


III. Emergency Treatment Release and Information

I understand that I must be healthy and reasonably fit in order to safely participate. If an injury or other medical condition arises, I HEREBY GIVE PERMISSION to the ISU representative to provide routine first aid and to seek emergency treatment including X-rays or routine tests. In an emergency situation, I give permission for an ISU representative to contact the individual(s) that I have listed under Emergency Contact Information. In the event of an emergency where I cannot decide for myself, I give permission to the physician/hospital selected by the ISU representative to secure and administer treatment for me, including hospitalization. I understand that during virtual programs I am solely responsible for monitoring my health and condition. If an injury or other medical condition occurs or arises during a virtual opportunity, I understand that ISU will not be available to assist or arrange for assistance.


IF VOLUNTEER IS UNDER 18 YEARS OLD. I understand that my child must be healthy and reasonably fit in order to safely participate. In the event of an accident or serious illness, I, parent/guardian, hereby authorize representatives of ISU to obtain medical treatment and transport for my child on my behalf. I waive my right to receive informed consent prior to and such transportation or treatment. I hereby hold harmless and agree to indemnify ISU from any claims, causes of action, damages and/or liabilities, arising out of or resulting from the medical treatment or transport. I further agree to accept full responsibility for any and all expenses, including medical expenses that may derive from any injuries to my child that may occur during their participation in the Opportunity. I understand that during virtual programs my child is solely responsible for monitoring their health and condition. If an injury or other medical condition occurs or arises during a virtual opportunity, I understand that ISU will not be available to assist or arrange for assistance.


By signing below, Volunteer attests they are 18 years of age or older, aware of, understand, and accept the terms and conditions of this Agreement and is signing this Agreement of their own free will.


IF VOLUNTEER IS UNDER 18 YEARS OLD. Volunteer and parent/guardian acknowledges that they are aware of, understand, and accept the terms and conditions of this Agreement.
