1) THAT roller skating is a participation sport and a dangerous activity. I represent that I understand the nature of this activity, and that I am qualified, in good health, and in proper physical condition to participate in such activity. I acknowledge that if I believe event conditions are unsafe, I will immediately discontinue participation in the activity. I fully understand that this activity involves risks of serious bodily injury to any and all parts of my body, including permanent disability, paralysis and death, which may be caused by my own actions or inactions, those of others participating in the event, the conditions in which the event takes place, or the negligence of the ”RELEASEES” named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the activity.

2) I acknowledge and understand the risk that participation includes possible exposure to, and illness COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. By visiting this skating event, you voluntarily assume all risks related to exposure to COVID-19. *

3) I understand Peak Skates does not provide instructions to skaters unless I specifically signed up for classes. Peak Skates has wrist guards available for use by every patron for a fee. I further understand that Peak Skates has no obligation to provide safety equipment wrist/elbow/knee guards or helmets. *

4) Photo Usage: I permit Peak Skates, to use images of me/my child in internal and external promotional material. This includes any printed material, broadcast and print advertising, promotional videos and the Peak Skates website which are produced or published by Peak Skates. I also permit Peak Skates to use images of my me/my child in broadcast and print media news coverage of Peak Skates.

5) PARENTAL CONSENT: AND I, the minor’s parent and/or legal guardian, understand the nature of the above referenced activities and the Minor’s experience and capabilities and believe the minor to be qualified to participate in such activity, I hereby Release, discharge, covenant not to sue and AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS each of the Releasees from all liability, claims, demands, losses or damages on the minor’s account caused or alleged to have been caused in whole or in part by the negligence of the Releasees or otherwise, including negligent rescue operations, and further agree that if, despite this release, I, the minor, or anyone on the minor’s behalf makes a claim against any of the above Releasees, I WILL INDEMNIFY, SAVE AND HOLD HARMLESS each of the Releasees from any litigation expenses, attorney fees, loss liability, damage, or cost any Releasee may incur as the result of such claim.

6) I UNDERSTAND THE SERIOUSNESS OF THE RISKS INVOLVED IN PARTICIPATING IN ROLLER SKATING ACTIVITIES AND THE POTENTIAL ADVERSE EFFECTS THAT THE CONSUMPTION OF ALCOHOL MAY HAVE ON MY (AND OTHERS) ABILITY TO SAFELY PARTICIPATE IN ROLLER SKATING AND NON-ROLLER-SKATING ACTIVITIES. I ACCEPT PERSONAL RESPONSIBILITY FOR ADHERING TO THE APPLICABLE RULES AND REGULATIONS AND ACCEPT THEM AS A PARTICIPANT. I AGREE THAT I AM PARTICIPATING SOLELY AT MY OWN RISK. *

7)I HEREBY RELEASE, WAIVE AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST PEAK SKATES AND ITS PREDECESSORS, SUCCESSORS, AFFILIATED ENTITIES, EMPLOYEES, AND/OR AGENTS, ATTORNEYS, VOLUNTEERS, REPRESENTATIVES, HEIRS, AND ASSIGNS (THE “RELEASED PARTIES”), EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF THE RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT OF POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS, ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY PARTICIPATION WITH THE ACTIVITY.

8) I hereby agree to accept the terms and conditions of this contract. This document constitutes the final and entire agreement between Peak Skates and me. I understand that Peak Skates has made no warranties expressed or implied to me.

9) I have read and understand this agreement. I understand that by making and signing this agreement, I surrender valuable rights, including but not limited to my right to sue Peak Skates, and all its successors, assigns, affiliates, officers, directors, employees, and agents for any common law negligence or liability under the North Carolina Roller Skating Safety & Fair Liability Act. [Chapter 99E, Article 2]. *

This agreement shall be governed by North Carolina law. In the event that one portion of this agreement shall be deemed unenforceable, then said provision shall be severed from the remaining provisions of the agreement & those remaining provisions shall be enforced.

BY SIGNATURE, I HEREBY AGREE TO FREELY & EXPRESSLY ASSUME & ACCEPT ANY & ALL RISKS OF INJURY WHILE I AM ROLLER SKATING OR AS A SPECTATOR AT THIS EVENT/FACILITY EITHER CAUSED BY THE NEGLIGENCE OF PEAK SKATES OR OTHERS. I AM AGREEING TO THE ASSUMPTION OF RISK, I WAIVE LIABILITY AND ACKNOWLEDGE THE PRIVACY POLICY AND THE RULES OF THE RINK/EVENT.
