Information submitted on a Report of Violation form may be used to investigate and remedy violations of the Sick and Safe Time and Municipal Minimum Wage Ordinances. Data that identify complaining employees and that appear on Report of Violation forms are classified as nondisclosable "private data" (within the meaning of the Minnesota Government Data Practices Act). Minn. Stat. §§ 13.02, 13.79. Any data provided may be made accessible to any person, agency, or the public if doing so will “aid the law enforcement process,” or by court order. Minn. Stat. § 13.39. Once an investigation is closed and becomes inactive, data collected becomes public, except for data that identify complaining employees, which remains private. Id.
