WAIVER AND RELEASE OF LIABILITY AGREEMENT

READ BEFORE USING EXERCISE EQUIPMENT


  1. In consideration of my use of the exercise equipment and facilities provided by the City of Minneapolis (City), I waive any and all right of action against the City and its insurers, employees, officials and agents, for any injury or damage that I might suffer on or about the premises, or as a result of the use of the equipment or facilities, regardless of whether such injuries or damages result, in whole or in part, from the negligence of the City. This includes fitness classes held at all City sites and buildings, including but not limited to MCC and the Minneapolis Park and Recreation Board, as an extension of the fitness center.
  2. I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic) and losses of any type that may occur to me, and I hereby fully and forever release and discharge the City, its insurers, employees, officials and agents, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out the use of said equipment and facilities.
  3. I expressly agree to indemnify and hold the City harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me.
  4. I agree to be solely responsible for my safety and wellbeing. I understand that the City does not provide supervision, instruction or assistance for the use of the facilities and equipment.
  5. I agree to comply with all rules imposed by the City regarding the use of the facilities and equipment.
  6. I agree to conduct myself in a controlled and reasonable manner at all times, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose.
  7. I understand and acknowledge that the use of exercise equipment involves risk of serious injury, including permanent disability and death.
  8. I understand and agree that the City is not responsible for property that is lost, stolen or damaged while in, on, or about the premises.
  9. I understand and agree that my use of the facilities and equipment is only to be undertaken on my own personal time, not work time. Use of the facilities and equipment is not assigned work and is not compensable as work. My use of the facilities and equipment is not within the course or scope of my employment.
  10. I agree that any controversy arising out of this Waiver and Release of Liability Agreement shall be resolved under the laws of Minnesota and by arbitration by the American Arbitration Association pursuant to Consumer Arbitration Rules.
  11. I agree that if any part of this Waiver and Release of Liability Agreement is deemed unenforceable, the remainder will remain binding and enforceable.
  12. It is my express intent that this Waiver and Release of Liability Agreement shall bind the members of my family, if I am alive, and my heirs, assigns and personal representatives if I am deceased.

PROCEDURE GUIDE

Eligibility

Only current City of Minneapolis employees are eligible to utilize the Fitness Center and must read and sign the liability waiver and procedure guide prior to gaining access to the space.


Hours of Operation

  • Monday – Sunday 24/7 Access


Staffed Hours

  • Monday: 9:00 a.m. - 5:00 p.m.
  • Tuesday: 8:00 a.m. - 5:30 p.m.
  • Wednesday: 7:00 a.m. - 7:00 p.m.
  • Thursday: 6:30 a.m. - 3:00 p.m.
  • Friday: 7:00 a.m. - 1:00 p.m..


Location

  • The fitness center is located on the 10th floor of the Public Service Building located at 505 4th Ave. S.
  • Take the elevator to the 10th floor (you must use your badge once in the elevator to access the floor) and follow signs to the fitness center.

Non Staffed Center Access

  • To access the fitness center 6pm to 6am, weekends and holidays, enter on the 4th avenue door by (using your badge or buzzing the guard)
  • To ensure safety, please sign in at the security desk on the first floor of the Public Service Building . Security will monitor the sign-in sheet and periodically check-in at the fitness center during their rounds.


Lockers

  • Lockers are for daily use only. Belongings are not to be left overnight. Items left overnight may be removed and placed in the lost and found.


Etiquette

  • When other employees are waiting, please restrict use of any equipment or station to 30 minutes or less.
  • Wipe down all touch points on the cardiovascular and weight equipment after use. Disinfecting wipes will be located throughout the center.
  • Allow others to “work in” between sets on free weight and resistance equipment.
  • Return all equipment to the location where it was stored before use.
  • Do not drop or throw weights. Lower and place equipment down in a slow, controlled manner.
  • Appropriate exercise attire and shoes must be worn at all times in all common fitness areas.
  • Open-toed footwear is not permitted in all exercise areas.
  • No taking pictures of or video in the fitness center.
  • You must use headphones with all personal music and video devices.


Security Measures

  • You are exercising at your own risk. Each individual is responsible for his/her own safety.
  • If possible work out with a buddy during unstaffed hours.
  • Pull cords are placed throughout the Fitness Center. In the event of an emergency, pull the cord and Security will be notified.
  • Two AED’s are located in the Fitness Center.
  • The Fitness Center staff is not responsible for lost, damaged, or stolen items.


Use of the City of Minneapolis Fitness Center is a privilege. Disregard for any Fitness Center procedures or failure to cooperate with the Fitness Center staff may result in the loss of your Fitness Center privileges.
