Regular, dependable in-person attendance is an essential function of every position at Lincoln Public Schools. Generally, leaves are provided in accordance with District policy, state and federal law—including but limited to the Family and Medical Leave Act (FMLA), Americans with Disabilities Act (ADA), Pregnant Workers Fairness Act (PWFA), or workers’ compensation—as well as agreements with the various classified employee groups. Requests for leave without pay are considered on an individual basis. Unless provided by law, unpaid personal leaves are not an employee right, benefit, or entitlement and are granted at the sole discretion of LPS.
Employees are further expected to not abuse leaves and to use them when necessary. Abuse of leave privileges may be subject to discipline, up to and including termination.
All applicable paid personal leaves, or any applicable FMLA leave, generally must be exhausted by the employee before unpaid leave will be approved. Unpaid leaves for non-health reasons, including vacations, are discouraged by the District. Employees do not accrue leave balances during the duration of unpaid leave.
