Lennar - Photo Release Form

In consideration of the mutual promises contained herein, the undersigned hereby agrees to the terms and conditions of this License and Release Form (“Form”):

I, on behalf of myself, my heirs and personal representatives, hereby authorize and grant to Lennar Corporation, and its parent, subsidiaries and affiliates, their advertising and promotional agencies, and their respective representatives, contractors, agents, licensees, successors, and assigns, and all persons acting under its permission or authority or those for whom it is acting (collectively, “Lennar”), a perpetual and irrevocable, paid in full, worldwide license to use, display, publish, publicly perform, reproduce, modify, enhance, improve, distribute, develop, market and sublicense for all types of business, advertising and promotional materials, communications, and any other purposes, in all types of media now known or later developed or perfected, including but not limited to, all types of internet and social media distribution and usage, video and audio recordings, distributions and streams, and printed materials (“Media”), (i) my name, voice, physical likeness, and statements, and (ii) all digital and analog still and video images and animation, prints of images, and digital and analog representations of myself and of the business or property owned or controlled by me, whether alone or in combination with other persons, taken on or about the date below (collectively, “Works”). This license is granted with respect to Works containing images of me or in which I may be included, in whole or in part, or composite or distorted in form, without restriction, in conjunction with my own name, or reproductions thereof in color or otherwise, made through any Media. I specifically consent to digital compositing or distortion of any Works, including without restriction any changes as to color, size, shape, perspective, context, foreground or background. I also consent to the use of any published matter in conjunction with such Works. I hereby waive any right that I may have to inspect, review or approve any finished products and the advertising copy or other matter that may be used in connection with the Works or the use to which they may be applied.

I hereby release, discharge, and agree to hold harmless Lennar from any from any and all claims, demands, causes of action, or liability for use of the Works by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, that may occur or be produced in the taking of images or in any subsequent processing of them in the Works, as well as any publication of them, including without limitation any claims for defamation or violation of any moral rights or rights of publicity or privacy. I confirm that this release does not create any obligation of Lennar to make any use of any rights provided under this release or to provide any acknowledgement or compensation to me for the rights granted under this release. The terms herein shall be governed in accordance with the laws of the State of Florida. All disputes shall be resolved by the courts of the State of Florida, and I consent to the jurisdiction of such courts. If any term, clause or provision hereof is held invalid or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity or operation of any other term, clause or provision and such invalid term, clause or provision shall be deemed to be severed.

This Form constitutes my entire understanding, and revokes and supersedes all prior agreements between Lennar and me, including any option agreements which may have been entered into between the parties, and is intended as a final expression of my license and release. It shall not be modified or amended except in writing signed by Lennar and me and specifically referring to this Form. The terms herein shall take precedence over any other documents which may be in conflict with this Form. The undersigned represents and warrants that he or she has the power and authority to grant the rights contemplated by this License and Release Form and that the publication and use of my name, voice, physical likeness, and statements, or any other use as contemplated by this Form, will not infringe upon any proprietary rights, or rights of privacy, of any person or entity. I further confirm that as between Lennar and me, Lennar Corporation, its parent, subsidiaries, affiliates or designees, shall solely own all right, title and interest in all materials, including copyrights and all other intellectual property rights, developed by or for Lennar in connection, with embodied in, and/or associated with any or all of the Works. I hereby assign all such rights to Lennar Corporation accordingly. By filling out the form below, I hereby warrant that I am of full age and have the right to contract in my own name. I have read this Form and I understand its contents and intend to be legally bound this Form.
