Written Request for 100-Mile Alternate Nonresident Tuition Program

DIRECTIONS

General academic teaching institutions shall use this form to submit written requests, pursuant to Texas Education Code, §54.0601, to offer an alternate nonresident tuition rate to eligible students. An institution may not offer or publish an alternate rate under this program until its request has been approved by the Commissioner of Higher Education.


Written requests for the 2026-27 legislative biennium may be submitted beginning January 15, 2025.

Rules for this program are located in Texas Administrative Code, Title 19, §13.122(f). Submitters are strongly encouraged to review the rules before submitting an application.

Institution Type*

Indicate whether this request is being made for a parent institution, an off-campus educational site of a parent institution, or both.


To be eligible for the Program, the parent institution or off-campus educational site must be located within a 100-mile radius of the boundary of Teas with another U.S. state.

Specify the primary physical address of the parent institution submitting the request.

Specify the primary physical address of the off-campus educational site submitting the request.

Academic Years Requested*

Indicate the academic year(s) during the legislative biennium for which the institution is seeking approval. Institutions must submit new requests for approval in subsequent legislative biennia to continue offering an alternate nonresident tuition rate under this program.

If you are submitting requests for both a parent institution and an off-campus educational site, please ensure your answers below clearly identify which parts of your answer apply to which site.

Describe the proposed methodology (or methodologies) by which the institution will determine the alternate nonresident tuition rate(s) for this program in the academic year(s) specified. If multiple methodologies are requested, specify the students to which each methodology will apply.

List the U.S. state or states, of which any portion is located within a 135-mile radius of the primary physical address of the parent institution or off-campus educational site, to whose residents the institution proposes to use the alternate nonresident tuition rate under the program.

Explain why offering an alternate nonresident tuition rate under this program would be in the best interest of the institution.

Explain why offering an alternate nonresident tuition rate under this program would not cause unreasonable harm to any other institution of higher education, as defined by Texas Education Code, §61.003.
