The NCRSWIFT System will perform the following:

  • A Complaints Official is assigned to your case.
  • The system shall perform automatic assessment of your case merit and eligibility for dispute
  • The NCR shall check the Dhs to establish debt review status and debt counsellor details.
  • The debt counsellor on record will be notified of the dispute to respond or resolve within 48 hours
  • Your will receive live updates of every step taken on your case.

The information and facts you supply must be true and correct in all aspects. Any incorrect or contradicting facts will be detected and will result in automatic deletion of your registration.

 
 
 
 

You can only placed under debt review if you voluntarily applied and singed Form16

 

To be placed under debt review you need to consult with a debt counsellor in person, not the office staff, reception or consultant.

 

If you did not sign Form16, the debt review placement is unlawful and should be removed.


Even if you consulted with a debt counsellor over the phone or you registered through a website, it is a legal requirement to sign a physical Form16 debt review application document to be placed under debt review.

Proof of income is required to assess your financial circumstance in order to qualify for debt review. Without it the debt counsellor cannot proceed with the debt review application.

 
 
 

The debt counsellor should draft a supporting affidavit for your commissioning in order to submit the debt review application to court.

 

All debt review applications are concluded with a court order to enforce the restructured payment arrangment. Where there is no court order, the debt review process is deemed incomplete.

The debt counsellor is obliged to issue you a copy of the court order.

 

The debt counsellor charges a fee for the service rendered, this fee is collected by the appointed Payment Distribution Agent (PDA)

 

Debt Counselling fees are regulated by the NCR and can range between R300 - R9000.

A Clearance Certificate is issued by a debt counsellor once you have settled all accounts that were placed under debt review.

 

Your Current Financial Circumstances

Whether you were lawfully or unlawfully placed under debt review, and there is no court order, you only need to prove that you are currently not over-indebted for the flag to be removed.

  • To dispute an unlawful debt review, you must submit a valid affidavit within 3 days.
  • The Affidavit must clearly state valid facts of non-compliance with specific Section 86 regulations, processes and procedures.
  • Self Drafted Police station Affidavit are not acceptable.
  • You can use your own legal practitioner to draft the affidavit or

  • You can upload any other documents related to the debt review eg: Form16, Form17.1; Form 17.2; 17.W; Clearance Certificate; Court order; ID etc
  • Once you have submitted this questionnaire, you will recieve email with a link to access and download mandatory dispute documements including Form29.
