Independent Contractor Request Form
This form is to assist you in determining whether a service provider can be hired as an Independent Contractor under USG and UGA guidlines.
What is an Independent Contractor?
An independent contractor is a person or business that provides services (e.g., consulting, training) under a written contract. Unlike employees, independent contractors do not work regularly for an employer but provide services as a business to multiple employers.
The determination of the Independent Contractor status is a collaborative effort between several University of Georgia Offices including, University Human Resources, Office of Legal Affairs, Procurement and Payroll.
Who cannot be in Independent Contractor?
- Current UGA employees (includes students who are currently employed)
- Supplemental Pay
- Temporary Employee
- Direct Hire Process Manual
- Current USG employees
- Dual Appointment
- Retirees from USG
- Employment Beyond Retirement
Important Note:
- Former UGA employees cannot receive a W2 and 1099 in the same calendar year. If attempting to rehire a former UGA employee within the same calendar year they were terminated, the unit will need to hire them as a temporary employee.
- A new request must be submitted each fiscal year.
- On average an Independent Contractor request takes five to seven business days. If more information is required UHR Special Employment will reach out to you.
Process for determination of Independent Contractor status:
- Complete the independent contractor form as accurately as possible. Liability resulting from misclassification could be attributable to the hiring unit.
- After the form has been completed & submitted, the information will be reviewed
- Additional information may be requested from the department and/ individual being evaluated:
- Business website
- Client List
- LinkedIn information
- Resume, if no social media webpage is available
- The determination of the independent contractor status and additional instructions will be sent to the department contact and HR Liaison provided in the request as well as UGA Procurement who will continue with the approval process.
- To expedite the procurement process, requestors should encourage new independent contractors to register with UGA at suppliers.uga.edu
Please note: The individual or company being evaluated should not complete this request. The submission of the request is the department’s responsibility, although the department may need to ask the individual or company for information to complete the request.
