EQUIPMENT CONTRACT

Required Identification

You must present your Aims ID in order to rent equipment from the Arty’s Adventure Program. The ID must belong to the person renting the equipment and signing the Equipment Liability Form.

Rental Periods

We have rental periods from one day to one week. Some rentals may be extended during holiday periods.

Cleaning

Please wipe down the equipment before returning, however, please only use water! Equipment will be properly cleaned upon return using the appropriate cleaning supplies.

Damage Fees

Damage fees will be assessed on all equipment that is returned damaged. Damages include, but are not limited to, lost items, burn holes, bent, broken or missing parts. When you rent an item, you have the opportunity to inspect the equipment for damage or missing parts prior to departing the Aims Physical Education and Recreation Center. Upon return, a final inspection by PERC staff will be completed to check for any damages. Avoid damage fees by taking care of the equipment and using it responsibly.

If damage fees exist, the following process will be followed:

•    Fees will be determined based on the amount of damage and cost of equipment

•    The fee will be charged to the student/employee account and payment can be made at the Cashier’s office

•    If payment is not made within 1 week, a hold will be placed on the student/employees account, restricting entry into the Physical Education and Recreation Center

Unreturned Items

If equipment is unreturned, you will be charged the replacement cost for the item, not its depreciated value. In the event the item is unreturned, the following process will be followed:

•    Fees will be determined based on the cost of equipment

•    The fee will be charged to the student/employee account and payment can be made at the Cashier’s office

•    If payment is not made, a hold will be placed on the student/employees Physical Education and Recreation account, restricting entry into the Physical Education and Recreation Center

Late Returns

Please return all equipment by the scheduled return date. If the item is not returned by the scheduled date, the following process will occur:

• A phone call will be made to the student/employee each day the equipment is late, for the first week

• After one week, a hold will be placed on the student/employees Physical Education and Recreation account, restricting entry into the Physical Education and Recreation Center

EQUIPMENT LIABILITY FORM



Please read this section carefully and thoroughly:

• I understand and agree that (1) the equipment that I have checked-out is in good condition, (2) I have a responsibility and the opportunity to inspect the equipment for damage or missing parts at the Physical Education and Recreation Center on the day I rented it and (3) I am financially responsible for any loss or damage to the equipment while it is in my possession

• I understand and agree that if the equipment is lost or destroyed while in my possession, I am financially responsible to pay the replacement cost for the equipment and not its depreciated value

• I understand and agree to return all items to the Physical Education and Recreation Center by the scheduled return date

• I understand and agree to release and discharge, indemnify and hold harmless the Board of Trustees for Aims Community College and its Trustees, officers, employees, agents, and any other persons or entities acting on their behalf, and their respective successors and assigns, from and against all claims (either in law or in equity), demands, and causes of action arising from my use, selection, adjustment, instruction on use, and/or any maintenance of the equipment to the fullest extent allowed by the law of the State of Colorado, including but not limited to negligence, and/or relating to injury, disability, death or other harm, to person or property or both

Assumption of Risk

I understand that participating in any activity entails inherent risk of injury. I am fully aware of the risks and hazards associated with my activity, and hereby elect to voluntarily participate in the activity. I voluntarily assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may be sustained by me as a result of participating in the activity
