Jailhouse Witness Data Collection Form

By September 22 each year, the Commissioner of Corrections shall publish on its website an annual report of the number of jailhouse witnesses who offered to testify or did testify statewide and show the number of additional uses of jailhouse witnesses annually by county. This will be non-identifying summary data pursuant to Minn. Stat. 13.02, subdivision 19. Further additional data needs to be collected pursuant to Minn. Stat. 634.045. This additional data is confidential pursuant to Minn. Stat 13.02, subdivision 3. This confidential data will only be disseminated to county attorneys upon their request to fulfill disclosure requirements regarding a particular jailhouse witness pursuant to Minn. Stat. 634.045 and Minn. Rule of Criminal Procedure 9.01 and/or to inform county attorneys of a particular jailhouse witness’s history. Under Minn. Stat. 634.045, your duty to report information regarding a jailhouse witness occurs whether or not you use the jailhouse witness at trial. The goal of this statute is to assist everyone in making credibility determinations regarding a jailhouse witness. Therefore, you should provide information in any case where a jailhouse witness offers to provide testimony against a specific suspect or defendant even if the case is never charged, the defendant pleads guilty, the case is dismissed or that witness is not used at trial. There is a place in the form where you will be able to explain your reason for not using the witness if that is the case. That information could be very helpful to other prosecutors in the future. Please complete this form thoroughly to ensure the accurate documentation of jailhouse witnesses, and do so in a timely manner, as soon you have determined if the jailhouse witness will not be used for whatever reason (including case not charged, case dismissed, or a guilty plea) or immediately after the trial where the jailhouse informant is used.
