Candidate Agreement

This is a formal agreement between the College of Naturopaths of Ontario and a candidate sitting the Ontario Clinical Sciences Examination. This agreement is binding and will be enforced to the full extent of the laws of the Province of Ontario.

The College of Naturopaths of Ontario (the "College")


AND

Herein referred to as the Candidate.

 


WHEREAS any individual seeking to become registered with the College in order to practise the profession of naturopathy in Ontario must successfully complete the Ontario Clinical Sciences Examination (“OCSE”).


WHEREAS the College offers the Ontario Clinical Sciences Examination (“OCSE”) in an on-line format.


AND WHEREAS the Candidate is seeking an opportunity to sit the on-line format of the OCSE.


THEREFORE, THE PARTIES AGREE AS FOLLOWS:

 

A. Definitions:

The following definitions apply to this agreement:


Candidate – Means a person who has fully registered to sit the OCSE.

College – Means the College of Naturopaths of Ontario.

Exam sitting – Means the full period in which the OCSE is delivered, including any breaks.

Meazure Learning – Means the third-party online examination administration and proctoring company who delivers the OCSE on behalf of the College.

OCSE – Means the Ontario Clinical Sciences Examination.

Privacy Policy – Means the Privacy Policy set by Meazure Learning as amended from time to time.

Terms of Service – Means the terms of service set by Meazure Learning for use of the ProctorU platform as amended from time to time.

 

1. The College will make the OCSE available for candidates who have met the College’s examination eligibility requirements, online through Meazure Learning, a third-party online examination administration and proctoring company (formerly Yardstick testing and ProctorU).

 

2. The Candidate understands that registration for the online OCSE is a two-part process whereby the Candidate must first register and pay for the examination with the College, by the deadline noted on the College’s OCSE schedule, and second, book their online examination time with Meazure Learning. Failure to complete both components by the timelines specified will result in the Candidate being ineligible to sit the online OCSE and forfeiture of the exam fee paid.

 

3. The Candidate understands and agrees to the collection of the following data by Meazure Learning for the purposes of confirming the Candidate’s identity and monitoring the Candidate’s actions throughout the online OCSE:

  1. Enrollment (CLPNA).
  2. First Name.
  3. Last Name.
  4. Created Username.
  5. Created Password.
  6. Time Zone.
  7. Phone number.
  8. Address.
  9. Email address.
  10. Photo of the Candidate.
  11. Photo of the Candidate’s ID, which may be a passport, Canadian driver’s license or provincial ID card.
  12. Recording of Candidate’s webcam during the exam sitting.
  13. Recording of Candidate’s screen during the exam sitting.
 

4. The Candidate understands that Meazure Learning is a company whose proctoring platform is based in the United States of America (“USA”) and agrees that the data set out in paragraph 3 will be held in the USA in accordance with the Terms of Service and Privacy Policy set by Meazure Learning, attached as Appendices 1 and 2 and forming a part of this agreement. The Candidate agrees that the provision of this data by the Candidate is at the sole risk of the Candidate and that the College is not responsible for the collection, use, storage, maintenance, or security of the data by Meazure Learning.

 

5. The Candidate understands and agrees that while the online OCSE is delivered in English or French, all online proctoring support will be available in English only. Furthermore, the Candidate agrees to waive any and all rights of action against the College in any court or tribunal in any jurisdiction based on this language limitation.

 

6. The College is responsible for ensuring the continuous delivery of the online OCSE content via the internet using the Meazure Learning platform. Should the Meazure Learning platform fail in the delivery of the online OCSE, and should the failure not be attributable to the Candidate’s internet connectivity, the College will offer the Candidate another attempt at the OCSE at its earliest opportunity and with no additional examination fees charged.

 

7. The Candidate is responsible for their own ability to connect to the internet to access the Meazure Learning platform via a web browser. Any connectivity issues, including but not limited to computer failure (hardware or software), and/or slow internet speed or loss of internet connectivity, that may arise for the Candidate, other than a failure of the Meazure Learning platform addressed in paragraph 6 above, are the sole responsibility of the Candidate.

 

8. If, in the delivery of the OCSE, the Candidate experiences a substantiated power outage, the College will offer the Candidate another attempt at the OCSE at its earliest opportunity and with no additional examination fees charged. Evidence, such as a hydro map showing the power outage for that day, time and area, will be required.

 

9. The Candidate agrees that should they encounter connectivity issues and/or lose the ability to continue with the online OCSE, all answers provided in the online OCSE will be lost and may not be recovered by the Candidate. The Candidate understands and agrees that once access to the online OCSE is lost, the Candidate will be required to restart the full examination at the next available sitting and will be required to pay additional costs for rebooking the examination.

 

10. The Candidate agrees that they are responsible for having access to a computer with the following hardware and software at the location where they choose to sit the online OCSE:

  • Screen/Monitor.
  • Keyboard.
  • Mouse or trackpad.
  • Webcam (desktop) or built-in laptop camera.
  • Microphone.
  • Google Chrome web-browser (most recent version).
  • ProctorU Google Extension for Chrome
  • Guardian Secure Proctoring Browser.
  • A mirror.
 

11. The Candidate agrees that other than the equipment set out in paragraph 10 above, no other equipment or personal belongings will be accessible to them during the exam sitting. This includes, but is not limited to:

  1. mobile phones (see Guide for more information)
  2. hand-held computers/personal digital assistants (PDAs)
  3. any other electronic devices
  4. any recording devices
  5. pagers
  6. watches
  7. wallets
  8. purses
  9. hats (and other non-religious head coverings)
  10. bags
  11. coats
  12. earplugs/earphones
  13. books, and/or notes.
 

12. The Candidate agrees that they may not access any electronic documents, nor access any websites outside of the exam administration and proctoring platform for the duration of the examination sitting for the online OCSE.

 

13. The Candidate agrees that for the duration of the examination sitting for the online OCSE, they will have no communication with any other person, by any means whatsoever, with the exception of the assigned examination proctor.

 

14. The Candidate agrees that for the duration of the exam sitting for the online OCSE they will be monitored (both audio and visual) and must be visible to the proctor from forehead to chin without obstructing their mouth. The Candidate further agrees that they will be recorded via their computer camera by Meazure Learning for any violation of the examination rules of conduct or any attempts to copy examination questions, or otherwise access information to answer examination questions.

 

15. The Candidate understands and agrees that each examination sitting of the online OCSE will begin once the exam is launched and the pre-checks process starts and that once access to the multiple-choice exam is granted, it will run for a four-hour period with a 15-minute break at the mid-session mark (i.e., after 2 hours or 100 questions, whichever comes first) unless additional time is granted by the College prior to the exam as part of an exam accommodation. The candidate acknowledges that they may not access or review questions from the first half of the exam once submitted. In the event that the Candidate requires a washroom break outside of the 15-minute mid-session break, they must communicate this to the proctor using the chat feature embedded in the examination delivery platform. The Candidate agrees that they will only be permitted to use the washroom once acknowledged by the assigned proctor and that the examination time will continue to run during this time. Further, the Candidate understands that, in returning to the test-taking area, they will be required to allow the proctor to perform a scan of the test-taking area.

 

16. The Candidate agrees not to access any equipment or personal belongings, as outlined in paragraph 11 and 12 above during the exam sitting. The Candidate agrees to only access snacks and beverages at the 15-minute mid-session break unless granted by the College prior to the exam as part of an exam accommodation.

 

17. The Candidate agrees and commits to making no attempt to capture any of the examination content in any form whatsoever. Furthermore, the Candidate agrees not to discuss the examination content with any other person or reproduce the examination content for any reason.

 

18. The Candidate understands that the purpose of providing Meazure Learning with the information and documentation set out in paragraph 3 above is to allow Meazure Learning and the College to verify the Candidate’s identity prior to the start of the online OBME. In the event that the Candidate’s identity cannot be verified (i.e., the Candidate presents expired ID, a non acceptable form of ID, or identification which does not match the name noted on the exam registration list during verification), the Candidate understands and agrees that they will not be permitted entry to the examination and that any exam fees paid will be forfeited.

 

19. The Candidate agrees that should Meazure Learning identify that the Candidate is in breach of the terms of this agreement, that the Candidate is engaging in activities designed to fraudulently assist them or others in successful completion of the OCSE or is engaging in activities designed to retain the examination content, Meazure Learning has the right to terminate the examination administration for that Candidate and report the activities to the College.

 

20. The Candidate agrees that should Meazure Learning terminate the examination administration in accordance with paragraph 19 above, all answers provided in the online OCSE will be lost and may not be recovered by the Candidate. The Candidate also understands and agrees that once the examination administration is terminated, the Candidate will not be reimbursed for the cost of the examination.

 

21. Should the Candidate require an accommodation to sit the online OCSE, an accommodation request shall be sent to the College in writing by the deadline set by the College. All requests for accommodation will be considered by the College, and a decision shall be provided within the time frames specified.

 

22. The Candidate hereby agrees that the results of their online OCSE may be canceled if there is a good faith basis to question the validity of their results for any reason, notwithstanding the absence of any evidence of the Candidate's personal involvement in the concerns. Concerns regarding the validity of the Candidate’s results, which may invalidate the Candidate’s results may include, but are not limited to, unusual keystrokes, unusual answer patterns or unusual score increases from one examination to another.

 

23. The Candidate understands the information and terms set out above. The Candidate agrees to the terms of this agreement and any other terms that the Candidate agreed to during the online OCSE registration process. The Candidate agrees that if they do not follow these terms or are suspected of cheating on the online OCSE or tampering with their computer hardware or software, this will be reported to the College, the Candidate’s results may be invalidated, and the College may take any other action to address the Candidate’s conduct.

 

24. The candidates hereby acknowledges and agrees that they have reviewed Appendix 1 and Appendix 2 to this agreement and the two appendices form a part of this agreement.

 

25. Signature of the College


The box below is checked hereby are affixing the signature of the Chief Executive Officer of the College of Naturopaths to this form and indicating that this form and the terms contained herein are bound to the College.
