We live in an age in which digital technology has vastly increased the use of photography and videography, and there has been publicity surrounding concerns about the risk of a child or young person being identified by a photograph in the local press or via social media. You should discuss the matter of photographs and videos with your child, and agree with them the circumstances in which they consent to the use of their image. We invite you to use this form to explore their feelings about being photographed and filmed. The FA will not use the full names (which means first name and last name) of any child or young person in a photographic image or film, website, or in our printed or digital publications, including marketing communications, unless we have your prior consent to do so. We follow The FA’s guidance on photography and video. We will also share information with media and press contacts in order to promote the EE Disability FA Cup:


National written press – meaning The Daily Express, The Sun, The Daily Mail, The Telegraph, The Evening Standard and other similar publications.


National magazine press – meaning Joe.co.uk, Sport Bible, Match Mag, Newsround, MOTD mag, The Week, Junior, Goal, Four Four Two, Kick and other similar publications.


Broadcast media – meaning BBC News, Sky Sports News, local news stations and other similar broadcast media outlets.


Online Press media – meaning The Press Association, The ‘I’, sports news websites and other similar online press media.


DURATION OF USE: 4 years from the date of event (28/06/2025 - 28/06/2029)


HOW YOUR FOOTAGE WILL BE USED:    


If you agree that the photographs and footage can be used for the purposes later selected in this form, then they may be selected to be published:

  • On The FA’s digital and social media pages
  • On England Football’s digital and social media pages, including in England Football paid media such as adverts on Facebook, Instagram, Twitter, Google and YouTube
  • On The League and Club Hub YouTube channel
  • On England Football Learning’s digital and social pages (including The Boot Room)
  • In or on official digital apps of The FA (including promotion thereof)
  • On The FA’s websites including EnglandFootball.com and thefa.com
  • In FA printed and digital publications such as match day programmes, posters or print adverts
  • In FA video, DVD or other media for use in FA education or training material
  • Non-educational FA videos
  • Within relevant printed publications
  • In FA strategy documents and/or annual reports
  • On our network of County FA social media pages, digital apps and websites
  • On the websites, social media pages and any other publishing platform of the organisations listed above

Purpose of use of footage

Please indicate below where you are happy for us to use your child's image for this purpose. You agree that The FA and Affiliated Football Associations can use the photographs/footage to:

Promote The FA, including its competitions and services, and the game of football in England, including within education and training material, marketing material and promotional videos*
Promote The EE Disability FA Cup in conjunction with EE*

Confirmation/Right to Withdraw Consent

(a)    I confirm that I am the parent or legal guardian of the child named above.

(b)    I confirm that I have discussed with my child and understand the implications of their photo/video being used for the purposes set out in this Consent form and that we have read (i) The FA’s safeguarding guidance and (ii) The FA’s privacy policy.

(c)    I confirm that my child may be photographed by Getty and filmed by 50 Sport on behalf of The FA, as set out above and agree to their images being used for the purposes I have ticked above. I am content to be contacted by The FA to confirm my wishes.

(d)    I understand that I have the right to withdraw my consent/consent on behalf of my child at any time by emailing dataprotection@thefa.com but understand that withdrawing my consent will not affect materials that have already been used in accordance with this Consent form .

PLEASE NOTE:

You should not permit your child to take part in the filming or have his/her photograph taken if you are not happy with your child’s personal data being processed in accordance with our privacy policy and the consents you have ticked, or you, your child or your family may be put at risk as a result of his/her participation. This is particularly important where you or your child is subject to a protection order.

Schedule 1: Terms and Conditions


This schedule sets out some important legal terms (the “Terms”) which apply to the Consent Form (the “Form”). Please ensure you have read and understood these Terms before signing the Form.


Nothing in these Terms is intended to override or limit your right to withdraw your consent on behalf of your child under the Form.


1.    Footage captured on behalf of The FA


If the applicable video footage, photographs or still(s) are shot by a photographer on behalf of The FA at shoot(s) detailed in the Form:


(a)    You agree to any and all usage (whether by The FA or any other organisations listed in the Form) of any such video footage, photographs and still(s) shot by a photographer on behalf of The FA (and any clips, cutdowns, variations or part(s) of it/them and any images or soundtrack taken from it/them) featuring your child’s image, voice and/or likeness on the shoots detailed in the Form (the “ FA Footage”) on a worldwide basis for the purposes set out in the Form.


(b)    You hereby agree to assign to The FA with full title guarantee, on behalf of your child, all intellectual property rights throughout the world in or attaching to the FA Footage that may vest in your child and any other rights in any and all media in the product of your child’s performance and any other material created pursuant to the event specified in the Form (the “Event”) absolutely for the full term of the Form (including any renewals).


2.    User generated content submitted by you or your child


If you or your child submit applicable video footage, photographs or still(s) featuring your child’s image, voice and/or likeness to The FA for the purposes detailed in the Form (“User Generated Content”), you hereby confirm that you took the User Generated Content and agree to an exclusive licence, and right to sublicence to the organisations listed in the Form, to The FA, on behalf of your child, the right to use any such User Generated Content for the purposes and duration of use detailed in the Form on a worldwide basis, including the right to clip, cutdown, or vary part(s) of the User Generated Content for such purposes.


3.    Additional terms relating to all Footage


In respect of the FA Footage and the User Generated Content (together, the “Footage”):


(a)    You irrevocably and unconditionally waive on behalf of your child all moral rights that may be vested in your child in respect of his/her performance in the Footage and agree that The FA or any other organisation listed in the Form may alter, adapt or edit the materials created pursuant to the Event in accordance with the purposes set out in the Form.


(b)    You agree that marketing materials used for the purposes set out in the Form do not need to be submitted to you for any approval and neither The FA nor any other organisation listed in the Form shall be liable to you or your child for any distortion or illusionary effect or adverse result to your child arising from the use or dubbing of the Footage in accordance with the purposes set out in the Form.


(c)    You agree and understand that nothing in these Terms shall oblige or require The FA or any other organisation listed in the Form to produce, broadcast or use the Footage (and any clips, cutdowns, variations or part(s) of it/them and any images or soundtrack taken from it/them) featuring your child’s image, voice and/or likeness on a worldwide basis and on any and all media (whether now existing or yet to be invented).


(d)    You acknowledge and agree that the terms of the Form and these Terms and all information relating to the Footage and marketing for the purposes set out in the Form (and any related campaign) is confidential and must not be disclosed to any third party without The FA’s written consent.


(e)    You agree that the opportunity for your child to appear in the marketing (as detailed in the purposes of the Form) shall constitute consideration in full and final settlement, with no further sums of any nature for any reason due to you.


(f)    In the event of any inconsistency between these Terms and the Form, the terms of the Form shall take precedence to the extent of the inconsistency.


(g)    The Form and these Terms shall be governed by the laws of England, whose courts shall have exclusive jurisdiction.


(h)    If the courts of England find any part of the Form or these Terms illegal, the rest will continue in force. Each paragraph of the Form and these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
